End User License Agreement

THIS AGREEMENT IS ACCESSIBLE ON WWW.SOFTACAR.COM AND CAN BE READ AT ANY TIME. ANYONE WHO PURCHASES OR RENTS THE SOFTACAR SOFTWARE IS DEEMED TO HAVE READ, UNDERSTOOD, AND ACCEPTED THIS AGREEMENT IN ADVANCE.

  1. PARTIES TO THE CONVENTION
    - Sitemio Information Technologies Trade Limited Company, referred to as "Sitemio".
    -  The "User" refers to the person or entity that uses the SOFTACAR software (i.e. you).

  2. SUBJECT OF AGREEMENT
    The "SOFTACAR" automation software produced by Sitemio Information Technologies LTD. is provided by the user to be purchased/leased and used according to the procedures and principles outlined below.

  3. LICENSE TYPES AND OBTAINING
    The license types and price information of the software are as specified on the website SOFTACAR.COM up to date. Licenses are defined on a single domain name and cannot be used in another domain name or subdomain. The user will choose any of the license package types he deems appropriate for him or her.

    3.1. Monthly License (Branded)
    The software is rented annually and the software contains some text that sends links to www.softacar.com website. These can be as follows: "car rental software", "rentacar software", "rentacar automation","car rental system" and similar forms. It is compulsory for the redirect links to be kept at the bottom of the site. In the event of any interference to remove, conceal in any way, the user agrees and declares in advance that the license purchased will be revoked and that the payment made will not be refunded under any circumstances.

    3.2. Obtaining a License
    Obtaining a license is provided via the www.softacar.com Web site and is operated via the www.sitemio.com.tr website. The user will be able to access the license information purchased or leased by providing customer information via the www.sitemio.com.tr website and download the installation files.

  4. LICENSE CHANGE/CANCELLATION OR TRANSFER
    Once the license has been obtained, the user may change the license information at any time at no cost. The purchased license cannot be transferred to anyone else. In order the cancellation process, the SOFTACAR software must have any problems, errors or issues arising from it, and it should not be corrected. Any feature that is not included in the software does not imply that the software is incomplete, inaccurate, or defective. Before purchasing the software, the user is obliged to inspect it thoroughly, to ask for information if necessary, and to determine if it is appropriate. The user accepts and declares it.

  5. TECHNICAL SUPPORT
    5.1. The user is entitled to request technical support at any time. The user will be required to provide technical support requests through the "support system" by providing customer input through the www.sitemio.com.tr website. Accepts and declares that will not receive support services in different ways. Technical support response times can take up to 24 hours on average, depending on the intensity status. The user agrees to this situation. Technical support services relate to the standard functioning of the software and the problems, errors and problems that will be experienced. Other considerations are not covered by support. Problems that occur due to erroneous and invalid interventions imposed on SOFTACAR software files are not considered under technical support and do not have any liability to Sitemio. In such cases, the user agrees and declares that the software will resolve the problem by uploading the original files and database back to the server.

    5.2. The user is obliged to provide the server hardware and requirements necessary for the smooth functioning of the SOFTACAR software. These requirements have been declared to the user before and during the purchase. In some cases, a number of additional features may be required on the base level. In such cases, the user agrees and declares that the features that Sitemio declares in addition shall be provided.

    5.3. The user agrees and declares that the SOFTACAR software will receive a paid support service for non-standard functioning.

    5.4. The user agrees and declares that he or she will pay for the different modules, requests and arrangements to be requested.

  6. LICENSE PAYMENTS
    SOFTACAR license payments are made in advance by credit card or bank transfer during the license creation phase. If no payment is made, the license is suspended on the next day of the last payment date and is cancelled if no payment is made. A license alert will automatically appear on the user's web site that is connected to the suspended license. The user accepts and declares this in advance. For lifetime licenses, a payment is paid and no other payment is made.

  7. UPDATES
    Updates and new versions may be applied on SOFTACAR from time to time. Update operations are done via the Admin Control Panel, Update Center. Sitemio is not obligated to share any information about the content, duration and scope of the updates and makes no warranty.

  8. THIRD PARTY INTEGRATIONS AND API'S
    A number of API integrations are available on SOFTACAR. These are API integrations and modules developed to enable third-party products and services that are not affiliated with the software to integrate with SOFTACAR. Sitemio is not responsible for any disruptions that may occur as a result of changes or errors to third party services with API integrators in their own infrastructure. Sitemio does not offer any guarantees that the APIs will work seamlessly for a lifetime.

  9. CHANGES IN THE AGREEMENT
    Sitemio may, at any time, modify the terms and conditions of this agreement in part or all of its products and services offered on the site. Changes will be effective from the date of publication on the site. It is the user's responsibility to track and control the changes.

  10. INTELLECTUAL PROPERTY RIGHTS
    10.1. The title, business name, trademark, patent, logo, design, and products contained in softacar.com and sitemio.com.tr are protected by all intellectual property rights, national and international law, registered or unregistered. The use of products and services in this agreement does not grant any rights to such intellectual property rights.

    10.2. SOFTACAR automation software cannot be reproduced, published, copied or transmitted in any way. The whole or part of it cannot be used without permission.

    10.3. SOFTACAR visual design and source codes are registered and all rights reserved. Only our web site, our dealers ' websites and authorized business partners are sold.

  11. THE INTEGRITY AND APPLICABILITY OF THE AGREEMENT
    If one of these contractual terms becomes partially or completely void, the remainder of the contract continues to retain its validity.

  12. NOTIFICATIONS
    All notices sent to Parties related to this Agreement shall be made via the known email address of Sitemio and the email address indicated by the user in the membership form. The user agrees that the email address specified during the member process is the current notification address.

  13. DISPUTE RESOLUTION
    The courts of Turkey/Istanbul Courthouse are authorized to resolve any dispute arising from the implementation or interpretation of this agreement.
